1. Acceptance of Terms

By accessing or using the PlanieWay mobile application and website (collectively, the "Service"), operated by PlanieWay ("we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service.

2. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are under 18, you confirm that you have the consent of a parent or legal guardian.

3. Account Registration

To use certain features, you must create an account. You agree to provide accurate, current, and complete information and to keep your credentials confidential. You are responsible for all activity under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period.

4. Use of the Service

You agree to use the Service only for lawful purposes. You shall not:

  • Violate any applicable law, regulation, or third-party right.
  • Upload or transmit content that is harmful, offensive, defamatory, or infringes intellectual property rights.
  • Attempt to gain unauthorised access to any part of the Service or its related systems.
  • Use automated scripts, bots, or scrapers to access the Service.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Impersonate another person or entity, or misrepresent your affiliation.

5. Subscriptions & Payments

PlanieWay offers a free tier and a paid Premium subscription. Premium features and pricing are described within the Service and are subject to change with reasonable notice.

  • Billing — Premium subscriptions are billed in advance on a recurring basis (monthly or annually) through your chosen payment method.
  • Cancellation — You may cancel at any time from your dashboard. Access continues until the end of the current billing period; no prorated refunds are provided.
  • Price changes — We will notify you at least 30 days before any price increase takes effect.
  • Refunds — Refunds are handled on a case-by-case basis. Contact [email protected] for assistance.

6. Your Content

You retain ownership of any content (trips, notes, photos) you create or upload through the Service ("Your Content"). By submitting Your Content you grant us a worldwide, non-exclusive, royalty-free licence to host, store, and display that content solely for the purpose of operating and improving the Service.

You represent that you have all rights necessary to grant this licence and that Your Content does not infringe on any third-party rights.

7. Intellectual Property

The Service and its original content (excluding Your Content), features, and functionality are and will remain the exclusive property of PlanieWay and its licensors. The Service is protected by copyright, trademark, and other applicable laws. Our trademarks may not be used without our prior written consent.

8. Third-Party Services

The Service may contain links to or integrations with third-party services (e.g. mapping providers, payment processors). We are not responsible for the content, policies, or practices of third-party services. Your use of such services is governed by their respective terms and privacy policies.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PLANIEWAY, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR USE, WHETHER IN AN ACTION IN CONTRACT, TORT, OR OTHERWISE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total aggregate liability shall not exceed the greater of (a) the amount you have paid us in the twelve months preceding the claim, or (b) $100 USD.

11. Indemnification

You agree to indemnify and hold harmless PlanieWay and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the Service.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive (e.g. intellectual property, limitation of liability, indemnification).

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which PlanieWay is incorporated, without regard to its conflict-of-law provisions. Any disputes shall be resolved in the competent courts of that jurisdiction.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
